Expert, Forensic & Investigation Services

Guildhall provides support in disputes relating to financial instruments such as derivatives, securities and spread betting; employment contracts and bonuses; trading and risk management technology; and business models in professional services.  Reported cases include Bankers Trust International v PT Dharmala (1995) and Kennedy v Dresdner Kleinwort Wasserstein (2004).

The majority of cases of this nature require extensive analysis of the financial contracts and portfolios underlying the dispute, including valuation, profit and loss, and risk (e.g. VaR).  Quantum has ranged from tens of thousands to hundreds of millions of pounds or equivalent. These activities are supported by recognised professional qualifications in expert witness, counter fraud and other relevant disciplines.

Mediation, Arbitration & Expert Determination

Mediation is now well established as an alternative to court litigation, arbitration and expert determination as a means of resolving disputes.  Arbitration and expert determination provide parties with the means to have their dispute adjudicated confidentially by one or more individuals with relevant commercial or technical as well as legal expertise. Guildhall has accredited mediators, arbitrators and expert determiners within its executive and associate pool with backgrounds in the specialist areas outlined above.
